§ 1 Provider and scope

(2) These General Terms and Conditions (terms) apply to the use of the websites mywishlists.de and mywishlists.com and to all contracts you conclude with us through these websites.

(3) Differing, conflicting or supplementary terms only become part of the contract if we expressly agree to their validity in writing.

§ 2 Subject matter of the service

(1) MyWishlists allows you to create wishlists and share them with other people through a link. Anyone who has the link can view the wishlist and reserve individual wishes. Use of this wishlist service is free of charge.

(2) We do not sell any goods ourselves. The wishes on a wishlist refer to offers in the online shops of third parties. A contract for a product offered there is concluded exclusively between you and the respective shop operator; ordering, payment, delivery and warranty are governed solely by that contract. Individual links are affiliate links and are marked as such. If a purchase is made through an affiliate link, we receive a commission from the shop operator. This does not increase the price of the product for you.

(3) In addition to the free wishlist service, a greeting page can optionally be booked for a fee. The greeting page is a page on which the guests of a wishlist collect greetings in the form of texts, photos and voice messages for the person receiving the gift, and which is delivered to the person receiving the gift on the occasion date (§ 6 (1)). Use of the wishlist service does not require the booking of a greeting page. The prices and term of the greeting page are set out in § 5 and § 6.

(1) Use of MyWishlists requires neither registration nor a user account. Instead, access is provided through individual links: for a wishlist, through a link for viewing and a link for editing; for a greeting page, additionally through a link for managing it and a link for leaving greetings.

(2) Each link enables anyone who opens it to use the functions for which the link is intended. We cannot check who uses a link and treat every request as authorised. You are therefore responsible for passing the links on only to people who are to have access to the respective functions.

(3) If a link has been lost, it can be requested again through the "Lost your link?" page. We send the management links of a greeting page exclusively to the e-mail address that was provided when booking.

§ 4 Conclusion of the contract

(1) Creating and using a wishlist is free of charge and does not give rise to any payment obligation.

(2) To book a greeting page, you select the occasion, the occasion date and the package on the start page of the greeting page and enter your name and e-mail address. Before you go on, you confirm with a tick that you accept these terms and have read the withdrawal policy; we record that confirmation with the booking. The "Continue to payment" button takes you to the payment page of our payment service provider. The contract is concluded as soon as you complete the payment process there. We confirm the conclusion of the contract to you by e-mail to the address provided.

(3) Until the payment process has been completed, you can correct your entries at any time using the "Change" button or your browser's back function. Until then, your entries are saved as a draft. If no payment is received within seven days, we delete the draft.

(4) The content of the contract results from the details you provide when booking and these terms. We do not make the contract text available for retrieval after the contract has been concluded. You receive the essential details of your booking with the confirmation e-mail and the invoice; you can retrieve, print and save these terms at any time at mywishlists.de/agb.

(5) The contract can be concluded in German, English, French, Spanish, Dutch and Polish.

§ 5 Prices and payment

(1) The greeting page is offered in the following packages:

  • Greeting page Basis: 6.90 €, term of twelve months, up to 30 greetings
  • Greeting page Plus: 14.90 €, term of 24 months, unlimited greetings

(2) All prices are final prices and include statutory VAT. There are no shipping costs.

(3) Payments are processed by Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Dublin, Ireland. The available payment methods are shown on the payment page. Payment data such as card details are transmitted directly to Stripe and are not made accessible to us. The invoice is issued by Stripe on our behalf and sent to the e-mail address provided when booking.

(4) The fee is due once upon conclusion of the contract and is owed solely by the person who booked the greeting page. Use of the greeting page is free of charge for guests who leave a greeting on a greeting page and for the person receiving the gift.

§ 6 Occasion date and term

(1) The occasion date is the day you state as the day of the occasion when booking and on which the greeting page is delivered to the person receiving the gift. If the occasion date is changed subsequently, the changed date applies.

(2) From the conclusion of the contract, guests can leave greetings on the greeting page. On the occasion date we deliver the greeting page to the person receiving the gift; from that point on, no further greetings can be left. After the occasion date, the greeting page remains accessible for twelve months with the Basis package and for 24 months with the Plus package (term).

(3) When the term expires, the greeting page is no longer accessible. No later than one month before expiry, we notify you by e-mail so that you can save the greeting page, for example as a PDF.

(4) The contract ends when the term expires without any need for termination. There is no automatic renewal.

(5) The person who booked the greeting page can delete it at any time. This does not give rise to any claim to a refund of the fee; § 7 remains unaffected.

(6) If a greeting page ends for whatever reason, in particular through expiry of the term, deletion or withdrawal, we permanently delete the greetings, photos and voice messages stored on it 30 days thereafter.

§ 7 Right of withdrawal for consumers

Consumers have a right of withdrawal for contracts for a greeting page in accordance with the following withdrawal policy.

Withdrawal policy

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period will expire after fourteen days from the day of the conclusion of the contract.

of your decision to withdraw from this contract by an unequivocal statement (e.g. an e-mail). You may use the model withdrawal form below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.

The withdrawal ends the greeting page; the deletion of its content is governed by § 6 (6). If you withdraw before the date of the occasion, we refund the fee in full in any case.

Early expiry

The right of withdrawal expires if we have fully performed the service and only began performance after you gave your express consent to this and at the same time acknowledged that you will lose your right of withdrawal once we have fully performed the contract.

If the chosen occasion date falls within fourteen days of the conclusion of the contract, the greeting page can only be booked if you expressly request during the ordering process that we begin performance before the withdrawal period expires. Otherwise we would not be able to deliver the greeting page in time for the occasion date.

§ 8 User content

(1) You are responsible for all content you post through MyWishlists, in particular for the titles, images and texts of wishes and for greetings, photos and voice messages on a greeting page.

(2) You warrant that you hold the necessary rights to this content. For photos, this includes the consent of the people shown to their publication. It is prohibited to post content that infringes the rights of third parties, violates criminal law or insults other people.

(3) All rights to your content remain with you. You merely grant us the simple, non-transferable right to store the content and make it accessible on the respective wishlist or greeting page for as long as it exists. No use beyond this takes place.

(4) Whoever manages a greeting page can approve or hide contributions. Whoever wrote a contribution can withdraw it through their personal edit link up to the occasion date.

(5) We remove content that violates this § 8 as soon as we become aware of it. In the event of serious or repeated violations, we are entitled to block the wishlist or greeting page concerned. Notices of unlawful content can be sent to us by e-mail to info@mywishlists.de.

§ 9 Availability

(1) We endeavour to keep MyWishlists available at all times, but we do not owe any particular level of availability. In particular, the service may be temporarily unavailable due to maintenance work, technical faults or outages at our hosting provider.

(2) Greeting pages are accessible exclusively through their link and are excluded from indexing by search engines. We cannot revoke a link that a person has passed on.

(3) We recommend that you back up important content yourself. A greeting page can be saved as a PDF using your browser's print function.

§ 10 Liability

(1) We are liable without limitation for damage arising from injury to life, body or health, for damage based on intent or gross negligence, in the event of fraudulent concealment of a defect, where we have assumed a guarantee, and under the German Product Liability Act.

(2) In the event of a slightly negligent breach of an essential contractual obligation, our liability is limited to the foreseeable damage typical for this type of contract. Essential contractual obligations are obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely.

(3) Otherwise, our liability for slightly negligent breaches of duty is excluded.

(4) The above limitations of liability also apply in favour of our vicarious agents.

(5) The operators of third-party websites to which a wishlist refers are solely responsible for their content, in particular for the products, prices and delivery terms offered there.

§ 11 Changes to these terms

(1) We are entitled to change these terms with effect for the future where there is an objective reason for doing so, in particular the introduction of new features or a change in the law or in case law.

(2) For contracts for a greeting page that have already been concluded at the time of the change, the terms valid at the time the contract was concluded continue to apply unless you expressly agree to the change.

§ 12 Final provisions

(1) The law of the Federal Republic of Germany applies. If you are a consumer, this choice of law applies only insofar as it does not deprive you of the protection afforded to you by the mandatory provisions of the law of the state in which you have your habitual residence.

(2) Should individual provisions of these terms be or become invalid in whole or in part, the validity of the remaining provisions remains unaffected. The statutory provisions take the place of the invalid provision.
